DUTIES AND FUNCTIONS 

1. Conduct hearing and adjudication of administrative cases of PNP members; 

2. Conduct review of cases as may be referred on first instance or on appeal; 

3. Provide legal assistance facing service related offenses; 

4. Provide and render legal opinion on matters relating to the IAS areas of functional interest; 

5. Draft and review contracts to be entered into by IAS with a third party or agency; 

6. Investigate and review application for availment of benefits under PD 448 filed by IAS member; 

7. Conduct legal research on matters referred to it needing study and review; 

8. Conduct periodic research on jurisprudence related to police administrative cases and compile the same for reference; 

9. Prepare reports of accomplishments in the adjudication of administrative cases of National and Regional Office for submission to PNP and NAPOLCOM for policy formulation; 

10. Coordinate with and assist the Office of the Solicitor General (OSG) on all matters involving petition for certuarri, prohibition and the like filed with the proper courts and prepare reports on the status and progress of those cases from time to time; and 

11. Perform such other tasks as the Inspector General may direct.

 

Docket and Research Section 

1. Receive appeals, complaints, answers, other pleadings and all other documents for appropriate action and record the same in the RECORD BOOK; 

2. Docket, complaints, appeals and other related documents and prepare index indicating actual status of cases; 

3. Raffle cases for assignment to designated summary hearing officers; 

4. Serve decisions, resolutions, orders and other documents to proper parties and to monitor their actual receipt; 

5. Verify all applications for clearance; 

6. Prepare routing slips for documents needing appropriate action of other Divisions or of the Inspector General (IG), and have them received by the divisions concerned; 

7. Prepare and submit monthly or other periodic reports; 

8. Serve as the Division’s coordinating unit for administrative, personnel and financial matters including supplies and logistical requirements; and 

9. Perform such other assignments as may be required by the Chief of the LAD or the Inspector General.

 

Summary Hearing Section 

1. Issue summons, subpoena orders, resolutions and other documents necessary in the conduct of a hearing; 

2. Conduct summary hearings; 

3. Prepare report of investigation for the submission to the Inspector General for approval; 

4. Prepare draft decisions for review and signature of the Inspector General; 

5. Investigate and review application for availment of benefits under PD 448 filed by the IAS personnel; 

6. Ensure that all summary hearing officers submit the necessary Summary Hearing Report Monitoring Form 2 which shall form part of the reports accomplishments in the adjudication of administrative cases of National and Regional Offices for submission to the IG, Chief PNP and NAPOLCOM; 

7. Monitoring activities of Regional Summary Hearing Officers and submit findings and proposals for remedial measures in relation to the procedure and substantive findings in the conduct of Summary Hearings in the Regional IAS Offices; 

8. Ensure security of all case records; 

9. Record all proceedings through the assigned Stenograhic Reporters; 

10. Recommend issuance of preventive suspension orders to the Inspector General; and 

11. Perform such other task as may be directed by the C, LAD or the Inspector General.

 

Legal Research Section 

1. Conduct research on jurisprudence related to police administrative cases and compile the same for future reference; 

2. Provide and render legal opinion on matters brought before it for legal opinion and research; 

3. To submit comments and/or opposition whenever required by the court or other disciplinary authority; 

4. Conduct research on matters referred to it for review and study; 

5. Draft and review contracts to be entered into by the IAS with a third party or agency; 

6. Compile all decisions rendered in administrative cases by the IAS nationwide, whether on first instance or on appeal; 

7. Assist in training on matters pertaining to the investigation, conduct of summary hearings and other matters related thereto; and

 

Appellate Section

1. Receive, reviews and evaluate appeals from decision of the RIAS; 

2. Draft Decisions or Resolution of appealed cases for IG’s signature; and 

3. Prepare indorsement to the NAPOLCOM in cases where the decisions of the IG are appealed to the NAB.
